Traditional Medicine Patent in Nigeria
For centuries, traditional medicine has thrived as a
critical cog in Nigeria's healthcare delivery system, weathering the onslaught
of conventional medicine. However, the burgeoning global appetite for natural
remedies has spurred the need to regulate and safeguard traditional medicine.
Patenting presents an avenue for this protection. This discourse scrutinizes
the legal and practical aspects of patenting traditional medicine in Nigeria. It
delves into the legal framework governing such patenting, the labyrinthine
obstacles encountered in obtaining patents, and the pragmatic steps that could
enhance the patenting process. The paper posits that the government must foster
an enabling terrain for the registration and patenting of traditional
medicines, thus safeguarding the intellectual property rights of traditional
medicine practitioners. As the demand for natural remedies surges, the Nigerian government has started recognizing the value of traditional medicine and has taken steps to regulate its usage. Patenting is one way to protect the intellectual property rights of traditional medicine practitioners, but other measures like trade secrets and communal protection of the practices can also be implemented.
