Insecurity of title to land, and Land Reforms in Nigeria
The central focus of the research is on the reforms on land law, administration and management in Nigeria . Under the customary law, the prevalent problems are sale of one parcel of land to three or more people. All efforts by the government to solve the issue by legislation culminating in the Land Use Act,1978 did not solve the problem. Despite the Act, insecurity of title to land is on the increase. The research suggests that the solution to all the problems is by Registration of title to all land in Nigeria. For instance in Ikoyi and Victoria Island, where cost of land is very expensive, there is no litigation or Omo Onile or land mercenaries, where government by issues land certificate guarantees and the title of the owner is guaranteed and the title i s indefeasible We have to replicate this in Nigeria as we have in Australia, UK, Singapore and this will be put the issue of title to land to an end. The Objectives are to ensure uniformity in land holding in Nigeria in the nature of Land Use Act but to ensure security of title to land, which Land Use Act could not achieve. The methodology is doctrinal, relying on primary and secondary sources of law. . The result expected is certainty of title to land in Nigeria. The contribution to knowledge is there is no suggestion like this by any other researcher{s} on this. This will be the first time that will suggestion for reforms based on Torrens System or Registration of Title {and not instrument} will be make in Nigeria.
